We Support AG Paxton’s Lawsuit Against ATF Over Firearm Suppressor Regulation

The Texas Patriot Republic is standing in support of Attorney General Ken Paxton’s lawsuit against the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) over the regulation of firearm suppressors in Texas. As we previously reported, Texas House Bill 957, which was signed into law in 2021, creates provisions relating to the intrastate manufacture, marketing, and enforcement of firearm suppressors. The law also prohibits state and local governments from enforcing federal regulations that do not exist under state law.

Despite this state law, the ATF has continued to enforce federal regulations that restrict the sale and possession of firearm suppressors. Attorney General Paxton’s lawsuit argues that the ATF is overstepping its authority by attempting to regulate a state-legal activity and that this violates the Tenth Amendment and the Commerce Clause of the U.S. Constitution.

As Texans, we believe that state law should be respected and that the federal government should not interfere with our Second Amendment rights. The Texas Patriot Republic supports Attorney General Paxton’s efforts to protect our state’s sovereignty and our constitutional rights.

It is time for the federal government to recognize that Texans are capable of making our own laws and that we will not stand idly by as they attempt to infringe on our rights. We urge all Texans to stand with us in support of Attorney General Paxton’s lawsuit and in defense of our Second Amendment rights.
